Founder Decision Record FD-2026-09-07 — omnibus adoption of the September determinations

Version 2026-09-07Decided 2026-09-07 · FD-2026-09-07Englishdecision_register (reference FD-2026-09-07), as read on 1 October 2026

A decision record, served as the programme record holds it. Whether it is signed is carried by the decision book, not by this page. A decision record is not amended after the fact: anything on its face that has since been overtaken is stated in the notice above the text.

Correction notice

Notice, 1 October 2026. The programme record holds no separate document of the founder's statement of 7 September 2026; the decision register entry is its record, and the text below transcribes that entry so that the decision has a text to be signed against. The subject, items and caveat are the register's words, reproduced exactly; everything else in the text is marked as the administration's. A different draft under the same reference, a founder decision to adopt an appointment procedure and appoint under it, was withdrawn before signature (MCC-QUO-2026-001); it is not this decision. Two things the entry does not say are recorded here. First, MCC-RAT-2026-001, the ratification map drafted for the Board on 10 September, reads items A1 to A7 differently: each of the seven determinations is drafted for the Board and carries a Board signature block, so in the map "the founder's adoption of a determination addressed to the Board is of no effect", and there is "nothing to ratify: the Board takes each on its own signature page". Second, on the same statement the register moved FD-2026-08-24 and FD-2026-09-01 from UNSIGNED, and FD-2026-09-03 from UNSIGNED with signature scheduled for 23 September, to ATTESTED; it deliberately did not move MCC-BDR-2026-002, a record of a Board meeting dated nine days before the Board was constituted. The decision register carries FD-2026-09-07 as ATTESTED (7 September 2026), executed copy not received.

Date of decision 7 September 2026
Made by Leif Martin Klakken, founder
Subject, as entered in the register Omnibus adoption of the September determinations
How it was recorded Entered in the decision register on 7 September 2026 from the founder's statement of that day that all of the instruments prepared for the Governing Board session of 23 September 2026 are adopted and signed by founder decision, and that the signed copies are archived. The programme record holds no separate document of that statement; the register entry is its record. A different draft under the same reference — a founder decision to adopt an appointment procedure and appoint under it — was withdrawn before signature (MCC-QUO-2026-001, header and Part D item 6); it is not this decision.
Register status when this text was filed ATTESTED — attested by the founder on 7 September 2026, "on the same terms and the same evidence as FD-2026-09-03"; the executed copy has not reached the programme record.
This text A transcription of the register entry, filed by the programme administration on 1 October 2026 so that the decision has a text to be signed against in the platform (D10): a signature binds to the SHA-256 of this file. The subject, the items and the caveat are quoted in the register's own words. Everything else — the headings, the field names and the other entries in this table, the arrangement of the items one to a row, and the line at the foot — is the administration's.

Items, as entered in the register

The register holds the items as one line, separated by "·". They are set out here one to a row, in the register's words, with nothing added or left out.

# Item
A1 MCC-DET-2026-001
A2 MCC-WDR-2026-001
A3 MCC-CA-2026-001
A4 MCC-TAX-2026-001
A5 MCC-F04-2026-001
A6 MCC-WDR-2026-002
A7 MCC-CLS-2026-001
A8 execution of FD-2026-09-03 item D5 — SCHEDULED, NOT EXECUTED
A9 the appointments and roster at MCC-QUO-2026-001 Annex 1 — NOT CARRIED

Caveat, as entered in the register

Adopted by founder decision under the transitional regime, and tabled for ratification under MCC-700 v4.0-draft cl. 23.6. Two items do not take effect. A9 is not carried at all: appointment to the Governing Board is a power of the Board (MCC-700 v3.1 cl. 4.1.1; MCC-001 v3.0-draft cl. 9.2.1) and the transitional authority to exercise a body's functions reaches only a body that is NOT constituted (MCC-700 v4.0-draft cl. 23.2); the Board is constituted. The founder's act on A9 is recorded and published as a NOMINATION, and Resolutions 1 and 2 of MCC-QUO-2026-001 Annex 1 stand for 23 September, where the two sitting members may take them without recusal — so nothing is lost by the refusal. A8 is scheduled rather than executed because D5 reaches MCC-001 v2.0, the Charter, and withdrawing it while its successor is a draft would leave the Programme with no constitution and dissolve cl. 0084, cl. 0081 and cl. 0093 — the grounds of the instruments adopted by this same decision.

Transcribed on 1 October 2026 by the programme administration from the decision_register row with reference FD-2026-09-07 (sort order 70), as it stood that day. The subject, the items and the caveat are the register's words; nothing else is. The migration ledger attributes the entry to 20260907200000_founder_decisions_attested_and_d5.sql, whose wording differs from the row in two places — the file adds "(section 2)" and "(section 3)" to items A8 and A9, and ends the caveat "A8 is scheduled rather than executed, per section 2." — and it is the row, not the file, that is transcribed here.
